General conditions of sale (C.G.V.)
These conditions of sale are concluded between the photographer Michel PAVIET Chemin de St Ferréol 48700 RIEUTORT DE RANDON, publisher of the site www.mpfoto.fr and any natural or legal person, residing in France, wishing to make a purchase, via the website www.mpfoto.fr , and hereinafter referred to as "the buyer".
Object
These conditions of sale aim to define the contractual relationship between Michel PAVIET and the buyer, and the conditions applicable to any purchase made via the website www.mpfoto.fr. The acquisition of a photograph (or "product") through this site implies unreserved acceptance by the buyer of these conditions of sale, which the buyer acknowledges having read prior to his order. The buyer declares that the purchase of photography (s) on the site is limited to strictly personal use and has full legal capacity to engage under these general conditions of sale.
These general conditions of sale can be modified at any time in order to comply with the regulations in force.
The conditions displayed on the site on the date of the order by the buyer apply.
Products
The products offered are the photographs which appear on the “Photo prints” page of the www.mpfoto.fr site, offered on various media and within the limits of available stocks. Michel PAVIET reserves the right to modify at any time and without notice the products presented as well as their characteristics. Before placing an order, the buyer should read the description and characteristics of the product. The visuals of the photographs on the site are as accurate as possible but do not bind the seller in any way.
As the products are manufactured specifically for each order, the right of withdrawal does not apply.
The sale of a product consists of the delivery of the ordered product (photograph and its support) and does not entail any transfer of rights to the photograph.
Prices
The prices are prices in Euros (€) exempt from VAT (article 293 B of the General Tax Code). Michel PAVIET reserves the right to modify the prices at any time. The price displayed on the day of the order will be the only price applicable to the buyer. The prices indicated include delivery costs for delivery in mainland France. In the event of a specific request from the purchaser, additional costs may be charged in addition.
Order and payment terms
To order:
Orders are placed and received exclusively via the website www.mpfoto.fr and processed by Michel PAVIET.
To place an order, the buyer, after filling his virtual basket by selecting the products and quantities desired, must click on the "order" button and provide information relating to delivery and method of payment.
Before validating his order, the customer has the possibility to check the details of his order and its total price, and possibly to modify his order. Confirmation of the order is made after accepting the C.G.V.
All information to be provided before validating the order must be given with precision and accuracy, in particular the delivery address and the telephone number.
We reserve the right to refuse any order if the price displayed and paid by the buyer proves to be inaccurate due to a technical or computer malfunction.
The order will only be considered final after full payment of the product (s) ordered by the buyer.
To pay:
Payment is made in full when ordering.
–Payment by check : the buyer must send his check made out to Michel PAVIET to the following address Michel PAVIET Chemin de St Ferréol 48700 RIEUTORT DE RANDON. The order will only become effective after receipt and cashing of the check.
–Payment by credit card or PayPal: the buyer can pay for his order via his PayPal account or with his credit card. The order is confirmed after validation of payment.
Title retention clause
Michel PAVIET retains full ownership of the products sold until the price has been fully collected, including any costs and taxes.
In the event of delivery and payment default, Michel PAVIET retains the right to claim ownership of the products ordered, the customer agreeing to return any unpaid product, all costs then being his responsibility.
Delivery
Deliveries are made to the address indicated on the order form and can only be done in mainland France, except with the written consent of Michel PAVIET and with increased transport costs accordingly.
Delivery is made within 30 days of ordering. If the period exceeds 30 days from the effective taking into account of the order, and is not due to a case of force majeure or to the fact of the customer, the order may be canceled and the buyer will be refunded on request. within 15 days.
Transport risks are the responsibility of the purchaser as soon as the items leave the premises of Michel PAVIET. The buyer is required to check in the presence of the delivery person, the condition of the packaging of the goods and their contents on delivery.
Warranties
The photographs sold on the site www.mpfoto.fr benefit from legal guarantees. In the event of proven non-conformity of a product sold, it may be returned to Michel PAVIET who will take it back, exchange it or reimburse it. All complaints, requests for exchange or reimbursement must be made within thirty days after delivery, either by post to the following address Michel PAVIET Chemin de St Ferréol 48700 RIEUTORT DE RANDON, or by email to mpfoto@free.fr.
Responsibility
Dans le processus de vente, Michel PAVIET n’est tenu que par une obligation de moyens. Sa responsabilité ne pourra être engagée pour un dommage résultant de l’utilisation du réseau Internet tel que perte de données, intrusion, virus, rupture du service, ou autres problèmes involontaires. Sa responsabilité ne peut être engagée en cas d’inexécution ou de mauvaise exécution du contrat due, soit au fait de l’acheteur, soit au fait insurmontable et imprévisible d’un tiers au contrat, soit à la force majeure.
Nous nous réservons le droit de modifier ou d’interrompre le Service (en tout ou partie) sans préavis et en tout temps.
No regulation specific to the country of delivery and / or consultation of the website can be opposed to Michel PAVIET.

Litigation
These conditions of sale are subject to French law.
